The Msida local council yesterday complained that drivers hit by falling concrete in Mikiel Anton Vassalli Street were holding them responsible when it was the central authorities that were to blame for poor maintenance.

The council felt it had to take the matter to court following declarations by two Transport Malta architects who denied that their employer was in any way responsible for the road. Their declaration was made during a Small Claims Tribunal hearing on vehicles that had been hit in this street. The judicial protest was filed against the Infrastructure Ministry, the Resources Ministry, the director of the Lands Department and the chairman of Transport Malta.

The council said thousands of drivers and pedestrians were risking their lives by using this road.

Since it was a main artery it was meant to be maintained by Transport Malta as laid down in the Structure Plan within the Development Planning Act, the council held. It was therefore holding the authorities responsible for any damages.

Lawyer Joe Mifsud signed the protest.
