A court dismissed an action for damages after ruling that Heritage Malta had repaired a chapel correctly.

Mr Justice Anthony Ellul heard that the Conservatorio Vincenzo Bugeja had engaged Heritage Malta to carry out restoration works on the cupola of a chapel in St Joseph High Road, Santa Venera.

The conservatory claimed there was water seepage because Heritage Malta had not carried out the works properly. This cost the conservatory €19,356 in repairs.

The court was asked to order Heritage Malta to make good for these damages. It denied the allegations.

In yesterday’s judgment, the court said Heritage Malta had been entrusted with a contract of works that consisted of cleaning the exterior of the chapel’s cupola, re-pointing and applying a water repellent.

The court heard that Heritage Malta’s architect had inspected the chapel after a heavy storm and saw no water on the chapel floor.

The architect noted two small water stains on the inside of the cupola, which could have been caused by condensation.

The court dismissed the conservatory’s claim.
