With reference to the article ‘On the court’s doorstep’ written by Andrew Borg Cardona (February 20), the Ministry for SocialDialogue, Consumer Affairs and Civil Liberties would like to clarify the following: In 2010, Borg Cardona together with Aron Mifsud-Bonnici and Matthew Brincat presented a paper to MCESDcalled ‘Modernising labour law to meet the challenges ofthe 21st century’, which included, among other issues, proposals to changes to the industrial tribunal.

The PN government did nothing about it and thus ignored the reality that, in Borg Cardona’s words “the Industrial Tribunal was ripe for change”.

On the other hand, under this administration, a discussion on the review of the Industrial Relations Act – including the composition and the process of the Industrial Tribunal – was initiated in the Employment Relations Board. This was well before the original court sentences which were given on June 18, 2015.

Soon after the Court of Appeals issued its decree on February 12, a Bill was presented with proposed amendments to rectify the issues raised by the Court sentences.

These amendments have now been discussed Parliament. Action was taken in days and not years. In view of the above it is evident that Borg Cardona is very forgiving of the previous administration to which he was advisor and instead of criticising it for napping on his report, resorted to writing derogatory comments on the present government which, as opposed to the previous one, has been taking action.
