Q: I ordered a three-seater and a two-seater sofa for €1,900. Upon confirming the order, I paid a €380 deposit.

The following day the seller called me to tell me that the two-seater sofa is no longer available. I was also told I could opt to take only the three-seater.

However, I need the two-seater and without it I don’t need the three-seater. At this point I told the seller I wanted to cancel the order and my deposit refunded. The seller refused my request and informed me that I could use the deposit to buy something else.

I would like to know if I am entitled to claim a refund of the deposit paid?

A: If the three-seater and two-seater sofas were ordered as a set, then since the seller is unable to provide you with both sofas as originally agreed when you placed the order, you may cancel the sales agreement and claim back the deposit paid.

Since you already asked the seller to refund you the deposit and the latter refused, you should complain in writing with the seller by sending a registered letter and, if your complaint remains unresolved, you may then file a complaint with the Office for Consumer Affairs.
