I have a residential tenement which is presently rented out to a Maltese person on a post-1995 annual agreement due to expire in January 2017. The agreement started in 2001, it is in writing and all the minimum details required by law are stipulated in the written contract. It has been renewed on an annual basis ever since albeit with several very late payments.

I would now like to sell the property with vacant possession but the tenant is refusing to move out.

Can I terminate the rent when it expires in January 2017 and request the tenant to move out? Should the tenant refuse/resist moving out, how can I evict him?
