The Technical Regulations Division of the Malta Competition And Consumer Affairs Authority informs the public that all lifts installed in Malta need to satisfy the following criteria to ensure the safety of users.

Every lift, according to L.N. 231 OF 2007 – Inspection of Lifts Regulation, needs to have at least one responsible person/administrator. If a responsible person/administrator is not appointed in a condominium, then all tenants will be held responsible for the lift.

The responsible person shall ensure that the lift is inspected and well maintained regularly, besides being registered with MCCAA.

Inspecting a passenger lift installed in a condominium means that at least once a year the lift is inspected by an authorised conformity assessment body (ACAB) with the aim of improving the safety of the lift, while a lift installed at a workplace needs to be inspected at least every six months.

The inspection, carried out at least once a year or every six months, is called a preventive inspection, while that carried out every 10 years is called a thorough inspection, which is a more systematic and detailed examination of the lift.

The ACAB shall determine, on the basis of the risk analysis performed during the thorough examination, the serious risks requiring immediate attention and those requiring modernisation works. A copy of these inspection reports have to be sent to the MCCAA.

When the ACAB reports are received at MCCAA, the responsible person/administrator shall receive a letter to acknowledge the receipt of the report of a preventive/ thorough inspection for the lift.

Should the Market Surveillance Directorate within the TRD encounter a lift which does not comply with legal requirements, it may take enforcement action according to law to ensure that the lift is brought to legal compliance.
