Q: I would like to know if the condition stating that damages caused by an act of God are not covered by a warranty is legal? I need this information because a local supplier does not want to honour my claim for a free repair or replacement because the product was burned by thunder.

A: Both the commercial guarantee given to consumers by traders and the legal guarantee stipulated in the Consumer Affairs Act give consumers the right to claim a free remedy when the product purchased results defective due to a manufacturing fault or when the product does not conform to the original sales agreement.

Hence, when a damage in a product is caused by an act of God, consumers cannot claim a free remedy from the seller. In such cases, unless the product in question is covered by an insurance policy that offers specific protection, consumers have to pay for any repairs that are necessary to fix the damaged product.
