Q: A year-and-a-half ago, I bought a laptop from a local seller. A few months later, the laptop was slowing down and its applications were crashing. When I returned the laptop to the seller, the latter did a low-level format but the problem wasn’t resolved. Through tests I found out that the hard disk was damaged.
I took it back to the seller with the relevant hardware report and they replaced the laptop’s hard disk free of charge. When I got my computer back, problems started cropping up again. The laptop was not booting up and I also found out that the new hard disk was damaged. At this point I also complained to the manufacturer abroad.
I took the laptop back to the local seller and they changed its hard disk and motherboard. Now, a few months after the last repair, I am experiencing the same problems. The hard disk is once again damaged. What are my rights? Am I entitled to a replacement or refund?
A: Since the seller has repaired the laptop several times and the same problem is recurring, legally you may request the seller to replace the defective laptop. At this point, you should not accept another repair if the seller offers you such a remedy. If a replacement is not possible, because the seller does not have a similar model to replace it with, then you may request to cancel the sale and claim a refund.
