Q: Two months ago, I bought a mobile phone from a local shop. Three weeks later it started giving me problems with the screen. After some arguments, the seller accepted to repair it. The repairing process took three weeks. Some days later, however, the same problems re-appeared. The screen is once again not working well.

I would like to know if I can ask the seller to replace the defective mobile phone with a new one or if I can request a money refund?

A: Since you purchased the defective phone less than six months ago and since it has already been repaired for the same defect, yes you may refuse a second repair and instead ask for a replacement.

You may opt to cancel the sale and ask for a refund if the seller is either unable to replace the mobile phone or if the replacement cannot be carried out within a reasonable period of time and this will cause you a significant inconvenience.
