Q: I ordered some furniture from a local supplier and when it was delivered to me I was requested to pay the outstanding balance. I refused because even though the seller delivered the furniture, it was still all packed up in boxes and it was not going to be installed on the same day of the delivery.

I was not even allowed to open the packaging as I was told it would void the guarantee. When I complained with the seller, I was told that the contract that I signed specified these payment terms. It is true that the contract says that full payment must be made upon delivery but it does not mention that the delivery and installation will be carried out on separate dates.

I would like to know what rights I have in this situation?

A: Since the sales contract does not specify that the installation will not take place on the same day of the delivery but, on the contrary, it gives you the impression that you will have the furniture delivered and installed on the same day, then you are not legally obliged to make the full payment on delivery but you can insist on paying the outstanding balance when the seller honours the sales agreement in full, that is, when the furniture is installed.
