In relation to legislation regarding the morning-after pill, Revel Barker (July 21) claimed that “unidentified and unelected people – not the MPs you elected to do that job – now make the majority of laws in Malta”. I understand he means the EU imposes its legislation on the Maltese Parliament also regarding the morning-after pill.
I suggest he reads the article that appeared on the European Dignity Watch - an information and advocacy network - on April 24, 2015. The article clearly and unambiguously states that “EU member states may restrict or totally prohibit sale of the ‘morning-after pill’”.
Furthermore, article 4.4 of Directive 2001/83/EC (November 6, 2001) regarding the Community code relating to medicinal products for human use, states: “This directive shall not affect the application of national legislation prohibiting or restricting the sale, supply or use of medicinal products as contraceptives or abortifacients. The member states shall communicate the national legislation concerned to the Commission.”
The above two quotes clearly stipulate that legislation enacted by the Maltese Parliament is supreme as far as the morning-after pill is concerned. In this respect, Malta would not have to look at the UK and see how itis doing.
