Q: I ordered parquet from a local supplier, which was delivered and installed to my satisfaction. After I started using this parquet, I was contacted by the supplier and was informed that it was not the model I had ordered. The seller told me they will have to remove the parquet to deliver it to the client it belongs to.

When the parquet was delivered to me, I didn’t realise it wasn’t the one I ordered, as it was very similar to the one I purchased. In fact, it looks almost the same.

I don’t want the supplier to remove the parquet, as this would cause me an inconvenience. I would like to know if I have the right to keep the parquet since it was not my fault that I was delivered the wrong parquet?

A: You are legally entitled to the product you ordered and paid for. Since it was not your fault that you were delivered the wrong product, the supplier may remedy the mistake but without causing you an inconvenience and at no extra cost.

Hence, if the supplier wants to take back the installed parquet, he will have to remove it and install the new parquet at no extra cost to you and without inconvenience.

If this is not possible and you are not offered adequate compensation, you may refuse the replacement and insist to keep the installed parquet.
