Q: We hired a photographer for our wedding and after several attempts to get the photos, the photographer informed us that part of the wedding photos were lost due to a hard disc failure. The lost pictures are of the reception – from when the dancing started to the cutting of the cake and all post wedding photos.

We have been told that the photographer has been trying to recover them for quite a while now. We are willing to wait a bit longer since what we want are the photos of our wedding day and post wedding, which was a day we will never have the possibility to relive. However, if this attempt fails, we would like to know what our rights are and what compensation we are entitled to?

A: Unfortunately, the Consumer Affairs Act does not stipulate a specific amount of compensation consumers are entitled to when something like this happens. If the photographer is unable to recover the lost photos, you are definitely entitled to compensation for damages suffered. In the first instance, you can claim a reduction in price for the services since you were not provided with all the photos and you may also make a claim for moral damages.
