Q: My fiancee and I paid a €200 deposit on our wedding rings when we ordered them from a local jewelery shop. We wanted the colour to be rose gold. The shop, however, did not have a sample of the rings in rose gold. Since we assumed that the colour of the rings would be the same, as we had seen elsewhere, we proceeded with placing the order.

When we went to pick them up, we noticed that the rose gold colour looked totally different to what we were expecting. When we complained with the seller about this and asked for a refund of our deposit, our request was refused. We were not even allowed to use the €200 on something else, unless we spend the total amount of the rings, which is €900.

What are our rights in these circumstances?

A: Before placing the order, it was your responsibility as consumers to request to see a sample of the colour of the rings. If such a sample was unavilable, you should not have placed the order. In such situations, for you to be entitled to cancel the sale and ask for a refund of the deposit, you need to provide evidence that the wedding rings sold to you by the seller are not rose gold.
