Q: Almost six months ago I purchased a Point of Sale software from a local company. Some time ago, I started having issues with the software and to date have not been resolved. The supplier keeps telling me he is checking about the problem but he has not yet managed to resolve it.

What are my rights? Can I ask for a refund?

A: Since a Point of Sale software is purchased to be used in shop/business premises, such sales transactions are business-to-business and therefore not covered by the Consumer Affairs Act. This means that the legal remedies provided by this Act cannot be applied in your case and the Office for Consumer Affairs cannot intervene to reach an amicable solution between you and the supplier. In other words, in this case you do not fall under the legal definition of ‘consumer’.

You are therefore advised to consult a lawyer to be guided about your legal rights and the remedies you may request from the supplier.
