Justice Minister Owen Bonnici insists he is right to ignore the advice of eminent legal personalities over the latest magisterial appointment, saying that while he respects their opinion – “they are wrong”.
In an interview with The Sunday Times of Malta, Dr Bonnici said he would not seek advice from the Commission for the Administration of Justice to ensure Caroline Farrugia Frendo – the Speaker’s 33-year-old daughter – meets the necessary criteria for a new magistrate.
To be eligible, a candidate must have practised law for at least seven years. Doubts were raised over Dr Farrugia Frendo’s credentials since she served part of that period as a court attorney.

In light of this, former European Court of Human Rights judge Giovanni Bonello (chosen by the government to lead judicial reform) and George Hyzler, president of the Chamber of Advocates, have urged the minister to seek the Commission’s assurance over her eligibility.
However, Dr Bonnici is insisting there is “no room for doubt” and no need to refer to the commission. “Although I respect these gentlemen, I disagree with them,” he said.
The nominations of Dr Farrugia Frendo and Ingrid Zammit Young, 43, as magistrates sparked controversy. Dr Zammit Young withdrew after the commission said it may be possible that she did not meet the criteria laid down in the Constitution.
Yet the minister is refusing to seek the commission’s advice on Dr Farrugia Frendo. He denied the choice was politically motivated.
