Q: A few weeks ago, we bought a set of pans from a local household store. Some days ago, a handle broke from one of the frying pans. We returned the frying pan and were told we would be contacted when it is repaired. Four days passed and we heard nothing from the seller. When we called, we were told we would need to wait at least another week.
We use this frying pan on a regular basis, so we cannot wait a long time to have it repaired. What rights do we have?
Consumer law stipulates that when a product results defective, consumers may ask for a free remedy from the trader. The legal remedies one may opt for are repair or replacement. The trader may try and repair the defective product. Hence, in your case you should allow the seller to repair the frying pan.
If the repair is not done properly or it takes an unreasonable period of time, then you may ask for a replacement. If a replacement is not possible, then you may ask for a refund.
