Q: I bought a suit from a local store and when I tried it again at home I noticed that one of the sleeves was damaged.

I immediately communicated with the seller and informed him I would be returning with the suit to have it exchanged.

If the suit cannot be ex-changed, what am I entitled to?

If the shop offers me a credit note, can I refuse it and ask for a full refund?

A: Since the suit was still brand new when you became aware of the defect, the law entitles you to request a replacement.

If replacement is not possible, because, for instance, the suit sold to you was the last one, then legally you are entitled to a full refund of the money paid. Should the seller insist on giving you a credit note, do not accept it.

If this happens, you should file a complaint with the Office for Consumer Affair so that one of our officers can speak to the seller on your behalf with the aim of reaching an amicable solution.
