Q: A few months ago, I ordered a bedroom and the delivery date agreed was the first week in August. When the due date was approaching, the supplier contacted me to inform me that the bedroom would not be ready in time. Since I had no particular hurry for it, we agreed on a later date.

A few days ago the bedroom was delivered to me. However, when I matched the design of the bedroom with the sketch we had agreed on when the sale was concluded, I discovered that two parts of the bedroom were not as I had ordered them. I only paid the deposit, so I still owe the supplier money.

I would like to know if I can refuse to pay the rest of the amount due unless the supplier changes the two parts of the bedroom that do not match the original sketch?

A: Since the bedroom was not delivered to you as agreed in the contract of sale, you should complain in writing with the supplier and request to have the parts that do not match with your order replaced free of charge.

Regarding payment, it is advisable that you do not pay the full amount until all the parts of the bedroom are delivered to you as had been agreed.

If the problem remains unresolved, then you may either claim partial compensation for the missing parts, or if these parts are fundamental for the bedroom and cannot be provided by the supplier, you may then opt to cancel the contract of sale and request a refund.
