A Freeport truck driver who suffered neck injuries when he drove into a pothole on one of the quays in January 2009 has won €6,750 in compensation after a judge ruled the Malta Freeport was responsible for the incident.

Vincent Dimech spent two months on sick leave recovering from a severe whiplash injury that affected sensitivity in his left arm.

The incident happened on January 30 when he was driving his truck along one of the terminals. It was raining at the time and the pothole, about 20cm deep, was covered in rainwater.

Mr Justice Anthony Ellul heard how the pothole was repaired a year later following a traffic management exercise by the Malta Freeport.

The judge concluded that the company was duty-bound to provide a safe workplace for its employees.

He heard how Mr Dimech was expecting €10,100 in compensation but he had already received €3,350 since the incident. The court therefore ordered the Malta Freeport to compensate Mr Dimech the remaining €6,750.
