A man who slightly injured a 10-month old toddler when he hit him in the face with his truck’s side mirror was cleared of criminal charges today due to lack of evidence.

Magistrate Neville Camilleri ruled that there wasn't enough evidence to prove that Keith Brincat, 37, from St Paul’s Bay, was driving negligently when he injured the baby boy.

The incident happened as the truck was being driven up St Vincent Street in Sliema at around 9.20am on Tuesday when an Italian mother came out of a house in the narrow street, holding the boy in her arms. 

Police Inspector Neville Mercieca said that the truck was being driver partly on the pavement. The court found no evidence to sustain this claim.

The magistrate upheld defence counsel Mark Mifsud Cutajar’s arguments that there was also no evidence to suggest that the truck was being driven negligently. The only evidence the court heard was that of the father, Guliermo Molina Rios, who was inside the house when the incident occurred and had not seen anything.
