Q: I contracted a local tradesperson to manufacture a kitchen for my apartment.

The design, including measurements of the kitchen units, was signed and included in the contract of sale. When the kitchen was ready, it was installed in my apartment while I was abroad.

When I saw it for the first time I immediately noticed that the installed kitchen did not conform to the agreed design. On the contrary, the final job was shabby and unprofessional.

What remedies or compensation am I entitled to in this situation?

A: If the kitchen delivered to you is different to what was agreed during the contract of sale, legally you have the right to ask the seller to make the necessary modifications at no extra cost, so that the kitchen delivered to you is as it was originally designed and agreed during the contract of sale.

If the trader is unable to provide you with the kitchen you have ordered, then you have two possible solutions. One is to request adequate compensation from the trader to make up for the kitchen’s shortcomings and keep the kitchen as it is.

The second option is to cancel the sales contract and request a refund of the money paid for the kitchen.
