A businessman has been ordered to pay his  former wife more than €1.2 million for breaching the conditions of a contract signed between them imposing a €1,000 daily penalty that kicked in four years ago.

The court heard how the two separated in November, 2009, and according to their separation contract she was to take half of a villa in Xagħra.

The contract gave the husband a year to free the property from any pledges, hypothecation and bank guarantees or face a daily penalty. The separation contract was amended and the year was extended to two years that elapsed on November 21, 2011.

Two companies belonging to the husband guaranteed his obligations, including the payment of the penalties. The wife filed the case against her ex-husband and the two companies.

She claimed that the two years elapsed but her ex-husband did not honour the contract. Magistrate Joanne Vella Cuschieri ruled there had been a breach of contract.

In line with the €1,000 daily penalty she ordered the husband to pay his estranged wife €1,292,000 to cover the period between November 21, 2011 and May 5 this year.
