What are my rights in this situation? Given that the product malfunctioned twice during the warranty period, doesn’t that confirm that it was faulty in the first place?
A: Since the convection oven has been purchased more than two years ago, it is no longer covered by the legal warranty, which is valid for two years from the date of purchase. Since the commercial guarantee has also expired, this means that legally and commercially you are no longer entitled to a free remedy. This despite the fact that the product has developed the same fault while the guarantee was still valid. Therefore, unless you reach a voluntary understanding with the trader, the latter is no longer obliged to provide you with free repair or replacement.
