Easygas has filed a judicial protest against the Malta Resources Authority, its CEO Anthony Rizzo and its chairman James Camenzuli to protest against their insistence that it should pass on gas cylinders in its possession to Liquigas.

Easygas claimed in its protest that the MRA did not have evidence that Liquigas was the ‘owner’ of these cylinders as defined by the Liquefied Petroleum Gas Market Regulations.

The regulations, amended in 2011, require the return of cylinders to the owner, which was redefined to mean “any natural or legal person established within the European Union, who lawfully holds certificates of conformity assessment of an LPG cylinder and who originally placed the said cylinder on the market”.

Easygas said that despite the failure of Liquigas to provide evidence relating to the original placement of the cylinders in question on the market so as to establish itself as their owner, the MRA was demanding the transfer of cylinders  to Liquigas.

It also accused the MRA of failing to require the return of several cylinders that belonged to it and that were in the possession of Liquigas even though it provided all evidence required to establish itself as the owner of these cylinders according to law.

The protest was signed by lawyers Adrian Delia, Lauro Fava and Karl Tanti.
