Q: I purchased a car battery from a local seller and it has developed a fault. The battery is still under guarantee. The local seller has done the necessary tests on the battery and confirmed that it is faulty.

However, he is refusing to replace the battery because he first wants to take up the issue with the supplier abroad. Since I am a client of the local seller and not the foreign supplier, am I right on insisting with the seller to replace the defective battery with a new one?

A: Legally, the local seller is responsible for replacing the defective battery regardless what the foreign supplier says. The seller is allowed to verify with the supplier but this should be done within a reasonable period of time and without causing any significant inconvenience to the consumer.
