Q: I was enticed from the road to enter a shop to try a hair straightener and I was persuaded to buy it for €124. When I returned home and researched the product online, I found out that the same product of the same brand was being sold at US$50.

I immediately went back to the shop to return the product but the seller told me he cannot refund me the money I paid.

I feel I have been scammed. What are my rights?

A: Since you were walking in a street when you were first approached by the seller, and the sale was concluded immediately afterwards, legally such transaction is considered off-premises which means that legally you are entitled to a 14-day cooling off period.

You therefore have 14 days during which you can change your mind about the sale and ask for a refund of the money paid.

You should immediately contact the seller to inform him that you want to cancel the sale.

It is important that unwanted goods are returned to the seller unused. If the seller refuses your request to cancel the sale, you may then file a complaint with the Office for Consumer Affairs.
