The Court of Appeal today ordered the continuation of a case instituted by the Grand Hotel Excelsior against Rod Stewart concert promoters after overturning a lower court decision that the case was time barred.

The case had been filed by the hotel against Raymond Steer Chetham, Jane Steer Chetham, Paul Degaetano, Josienne Degaetan, Jennifer Farrugia, Eugenio Farrugia in their capacity as partners in RS and Partners and Roy Steer as manager. The hotel requested payment of €7,762.40 for services provided for the Rod Stewart Concert in Malta between August 1-4, 2010.

In overturning the lower court's decision, the Appeals Court said the action did not fall within the legal definition of prescription since the case was not about a service to individuals, but about a commercial deal which was not restricted to accommodation but included other elements such as sponsorship.

The case, therefore, could continue.
