Q: I would like to know if I have the right to ask for my money back on a purchase made from a retail outlet in Malta. When I returned the item to the seller, I was only offered a credit note. I also presented the original receipt.

A: Whether or not you are entitled to claim a refund depends on the reason why you returned the product purchased. If you simply changed your mind or realised that you have made a wrong buying decision, then legally you are not entitled to a remedy and hence the seller, by offering you a credit note, went beyond his legal obligations.

If, on the other hand, you returned the product because it was defective, then you are entitled to have the product repaired or replaced free of charge.

If neither repair nor replacement are possible solutions, you may legally ask for a cash refund not a credit note.
