Q: Should a commercial warranty be given for one year or two years?

A: The commercial guarantee is a voluntary guarantee given to consumers when they purchase certain kinds of products. Since this guarantee is voluntary, the law does not stipulate for how long it should be given. However, besides the commercial guarantee, consumers have a legal guarantee which applies to all the different kinds of products consumers purchase.

This legal protection is valid for two years from the date of purchase and it gives consumers the right to claim a remedy free of charge if the product is either defective or does not conform to the contract of sale. This is the protection that the law gives to consumers and no trader can take it away.

Hence, when a seller gives a commercial guarantee for a period of time that is less than two years, it is not illegal, but consumers are still legally protected for two years.
