A construction firm director has been cleared of responsibility for his employee’s injuries after the man fell three storeys and suffered permanent disability.

Joseph Debono fractured his spine, collar bone, and both arms and legs.

Paul Polidano, 49, from Safi, brother of construction magnate Charles Polidano, Iċ-Ċaqnu, had been charged with responsibility through negligence for injuries sustained by Mr Debono as he was working on a site in Triq Mariano Gerada, Cospicua, in June 2003.

The court heard Mr Debono was working on a house demolition when he fell from the third floor as he was shifting bricks from the roof. One brick had a hook that caught his top and pulled him over the wall.

Magistrate Giovanni Grixti ruled that a proper assessment had been carried out and precautions taken.

He also heard Mr Debono saying that although he had health and safety equipment, he did not use it for this job.

Lawyers Michael and Lucio Sciriha appeared for the worker.
