An Appeals Court today threw out an appeal filed by the Attorney General who requested the revocation of a judgment whichhad cleared a lap dancer of charges related to prostitution and committing immoral acts.

Mr Justice Michael Mallia ruled that Sabrina Bonnett, 36, had not committed any immoral acts when she was found scantily dressed in the dressing room of a gentleman's club in November 2006.

The lap dancer had been acquitted of running a brothel, offending public morals and being indecently dressed on the night in question.

The Attorney General appealed the decision but Mr Justice Mallia, presiding over the Court of Appeal, ruled that being a pole or lap dancer did not constitute an immoral act. Neither was the fact that she was caught wearing a bikini top, panties and a mini skirt.

He said he agreed with the first court that there was no evidence to prove the club had been used as a brothel or for immoral reasons.

Lawyers Veronique Dalli and Dean Hili appeared for the accused.

In a separate but related case, the Appeals Court confirmed a judgment finding Duncan Fenech and Daniel Schembri not guilty of running a brothel in the premises where Ms Bonnett had been found.

It also revoked part of the judgment which had found them guilty of employing people without a permit.
