A 34-year-old woman was today acquitted of assaulting her estranged husband when he went to pick up their children, after a court noted there was insufficient evidence.
Magistrate Neville Camilleri heard how the woman, from Sliema, was charged with assaulting her husband and damaging his sun glasses on June 30, 2012, at about 4.15pm.
The incident happened when the husband went to pick up their children from Sliema. The husband said that the wife reached into the car, pulled his hair, pulled of his Ray Ban sunglasses and threw them inside the car, where their son was sitting.
But the magistrate noted that, when the husband filed a police report, he did not mention that she pulled his hair. Neither did he tell police that she broke the sunglasses but that she grabbed them and threw them in the car.
Besides, the husband said he had thrown away his Ray Ban sunglasses and they were not exhibited as evidence. When he submitted an estimate of the damage caused, the document said the sunglasses were Emporio Armani.
In light of these inconsistencies the court felt the charges had not been sufficiently proven.
