Q: Six months ago I bought a spin dryer from a local seller. The first time I used it, it made a loud noise. The following day I took it back to the seller to check it out. When the trader tried it out at the shop, the spin dryer made the same noises, so the seller replaced it with a new one.

At first the new dryer was working well. However, a few days ago the same thing happened. Besides the loud noise it also started to swivel and turn and consequently it fell down on the floor.

I took the spin dryer to the after sales department and the rep­resentative told me they cannot take it back because its body is damaged and the guarantee does not cover damages to the body. So they want to charge me to repair the spin dryer.

Do I have any legal rights in this situation?

A: If the damage on the spin dryer’s body was caused after the appliance fell on the floor because of its defect, legally you are entitled to a free remedy regardless of what the commercial guarantee says.

In your situation, you may ask the seller to either repair or replace the defective spin dryer free of charge.

If this is not possible, or if it causes you significant inconvenience, you may ask for your money back.

You should make such a request in writing and send the letter of complaint by registered post.

If you do not manage to reach an amicable understanding with the seller, you may file a complaint with the Office for Consumer Affairs.
