Q: I bought a small electronic domestic appliance with a two-year commercial guarantee. After 15 months, the appliance broke down. When I complained with the seller, he was willing to exchange it but did not have a similar model.

I was told I could choose a different model and pay the difference in price. I was willing to do this but when I asked about the warranty, I was told I would not be given a new one but will continue with the original warranty.

Does the seller have the right to refuse to give me a new warranty?

A: The original commercial guarantee continues to apply when the original product is replaced with a new one at no extra cost.

In your particular situation, if the seller cannot provide you with a similar model at no extra cost, then you may refuse the replacement and ask for a refund.
