Q: Would I have the same warranty on a mobile phone if I decide to buy it from the internet from another country? If I make such a purchase and the mobile phone eventually needs repair within the two years of the legal warranty, can the repair be carried out by a shop in Malta?

A: If you purchase the mobile phone from another EU member state, yes, the two-year legal protection in case of latent defects or non-conformity with the contract of sale still applies.

Whether any repair under the legal guarantee can be done in Malta or not, the law stipulates that the person responsible for providing the legal remedies is the seller of the product, hence in this case the foreign seller.

To have the right to go to the local agent to carry out any repairs free of charge, you will need to have an international warranty that clearly stipulates that the local agent is the guarantor and that they are responsible for carrying out any necessary repairs as per guarantee and at no extra cost.
