A 21-year-old woman who was charged with having sex with a 16-year-old lesbian school girl has been acquitted after both of them withdrew their initial admission and said they had just kissed.

The case came to light when the 16-year-old bullied classmates and threatened them that if they did anything to her, then she would get her 21-year-old girlfriend to stab them with a pen knife.  The case happened in October last year.

The concerned mother of one of the bullied victims spoke to the headmistress who in turn called the police. 

Testifying Sergeant Mifsud said the accused was very forthcoming and admitted to having a sexual relationship with the 16-year-old, something the schoolgirl also admitted to in front of the headmistress. The accused said that both the girl’s parents knew too and her mother allowed them into the house together.

When it came to releasing a police statement, the accused said that she did not have a sexual relationship with the girl and said the relationship was purely platonic. Testifying in court, the girl said that they were close friends and had kissed once or twice and added that she felt very comfortable with her and would talk to her about everyday problems.

The girl’s mother said that while she was at first uncomfortable with her daughters choices, she had come to accept the fact she was lesbian. She said she preferred her daughter to be around and with someone she knew rather than running around late night. She denied ever knowing that the two had a sexual relationship and said that in front of her they had always acted appropriately.

In considering the evidence Magistrate Consuelo Scerri Herrera said that the evidence against the accused was not enough to convict of her sexual abuse especially since it resulted that they had just kissed. The court believed that they were friends and acquitted the accused of all charges.
