Q: We purchased a free-standing fridge and freezer as two separate units and bought them at a reduced price from a showroom sale.

When the items were delivered, I noticed a dent on the fridge door. We immediately called the seller to send someone to our house to check it out.

The dent wasn’t there when we were at the showroom, so it must have been made during the delivery. In fact, the seller admitted the damage was done during delivery.

Can I ask the seller to replace the fridge door? What are our rights?

A: If the damage was done during delivery, then the seller is responsible. In this case, the law gives you the right to have the fridge door repaired or replaced. If it is too expensive for the seller to repair or replace the damaged door, he may opt to cancel the sale and give you your money back.

A money refund may also be claimed by you if repair or replacement is not possible or may cause you a significant inconvenience.
