Q: I bought a present and asked the seller to give me a gift receipt just in case the recipient would like to change it with something else. On the gift receipt, it was written that the gift could only be exchanged within a week. Is this legal? Shouldn’t there be a longer period of time?

A: Consumer law does not regulate how long consumers are allowed to exchange an unwanted item.

Unless the product purchased is defective, or does not conform with the contract of sale, the law does not give consumers the right to replace the purchased product.

The terms and conditions of return are usually set by the seller or specifically negotiated between the consumer and trader before the sale is concluded.

If, prior to the sale, you did not agree with the seller on a specific return date, the receiver of the gift must adhere to the stipulated date to exchange the gift.
