Q: I bought an appliance with a two-year guarantee. After 13 months, it broke down and so I took it back to the seller, who informed me it was beyond repair and offered me a new one of the same model. However, he does not want to renew the guarantee. Hence, I ended up with a brand new appliance, which is covered only by an 11-month guarantee rather than two years. I complained with the seller about this but he insisted the guarantee is tied with the money rather than the product.

Is this legally right? Can I insist on being offered the full guarantee with the new product?

A: The law stipulates that when a product is replaced with a new one while still under guarantee, the latter does not start from scratch but the original guarantee continues. Therefore, the seller is correct.
