Jeffrey Pullicino Orlando has lost a libel case he instituted in 2008 against then Opposition leader Alfred Sant over comments made in connection with the Mistra  permits controversy.

Dr Pullicino Orlando had complained over claims of corruption and that money had changed hands.  

Magistrate Francesco Depasquale found that what Dr Sant had said in a press conference, held a few days before the 2008 general election, constituted fair comment.

He said the comment was not malicious but was Dr Sant's opinion and value judgement based on his understanding of how matters had evolved.

Dr Sant, as Opposition leader, had had a duty to express his disapproval on what was being said. His comments were part of the political debate which should be protected by the court.

Dr Pullicino Orlando said he would appeal.
