The Inspection of Lifts Regulations apply to existing and new lifts. The first refers to a lift that has been installed and put into service before July 1, 2002, and the latter applies to lifts installed and put into service from July 1, 2002.

Included in the legal requirements set in these regulations there is the obligation for existing and new lifts to be registered as well as defining who is responsible for the obligations laid therein.

The Inspection of Lifts Regulations stipulate that the person responsible in the case of:

(a) dwelling houses and premises not falling within the ambit of any specific legislation, includes:

(i) the occupier of the premises, or where the number of occupiers is more than one, such occupier having authority to take appropriate action in relation to any lift;

(ii) in the case where no occupier/s are present, when the occupier/s are absent – the owner of the premises, and in cases where there is more than one owner, the responsibility shall be shared jointly by all co-owners; or any person in authority for the time being to take appropriate action in relation to the lift.

(b) in a condominium

(i) the appointed administrator if the number of condominiums is more than three;

(ii) the person in authority for the time being to take appropriate action in relation to the lift if the number of condominiums is three or less; or

(iii) in the case where there is no appointed administrator or person with authority as mentioned before – the owner of the premises, and in the case where there is more than one owner, the responsibility shall be shared jointly by all co-owners; any person in authority for the time being to take appropriate action in relation to the lift; or, in a workplace, the responsible person shall be the employer/s operating in or from the workplace as the case may be, and in case there are more than one employer, the responsibility shall be shared by all the employers jointly;

Registration

Existing and new lifts are registered with the Technical Regulations Division at the Malta Competition and Consumers Affairs Authority.

Any existing lifts should be registered by the responsible person.

For a new lift, registration needs to be carried out by the installer (as defined by the Lifts Regulations).
