I refer to reports in Times of Malta (January 15) and The Sunday Times of Malta (January 19) about the sharing of sexually explicit material.

Sharing sexually explicit material is already illegal. Article 208 of the Criminal Code deals with this. The law does not distinguish between material distributed with or without the subject’s consent.

The sharing of sexually explicit material without a person’s consent is also a clear breach of data protection. The law already provides for this in the Data Protection Act (Chapter 440).

However, the Information and Data Protection Commissioner has no legal jurisdiction to investigate cases where the material has been uploaded on websites based in other countries.
