I refer to the letter entitled ‘Price increase’ (The Sunday Times of Malta, January 5).

The Malta Communications Authority would like to reiterate that changes effected to service offerings in a competitive market are commercial decisions undertaken by the service provider and thus not subject to regulation and approval by this authority. One may refer to Article 20 (2) of Directive 2002/22/EC of the European Parliament and of the Council on Universal Services and Users’ Rights relating to Electronic Communications.

National legislation only empowers the MCA to regulate the manner in which such changes are communicated to impacted subscribers.

In this regard, Melita is required to notify subscribers 30 days prior to the proposed increase in price for a particular internet subscription, while giving such subscribers the opportunity to withdraw from the service contract without penalty, with all advance payments being refunded accordingly.
