Music promoter Grace Borg is appealing against a court decision dismissing her claims that former Malta Eurovision winner Thea Falzon Garrett had breached an exclusive management agreement.

In December, the court dismissed the case that Ms Borg and promoter Andrea Milana had instituted against the singer, Public Broadcasting Services Limited and the organisers of the Malta Eurosong festival.

Ms Borg and Mr Milana insisted that they had entered into an exclusive management agreement with Ms Falzon Garrett and demanded compensation for damages.

But the court found that that there was no contractual agreement and the singer had been needlessly dragged into the case.

Ms Borg, a former Malta Eurosong chairperson, pointed out that the singer had signed an exclusive management contract with Exotique Record Label before participating in the Maltasong contest.

After winning the contest, the singer had signed a contract with PBS, as is normal practice with Eurosong winners, which led the promoters to file the court case accusing the singer of breaching the Exclusive Artist Management agreement.

The court observed that the singer’s contest submission My Dream, turned into a nightmare for the young woman, who found herself in the midst of a legal battle over a contract she had never signed, and a warrant of seizure for €15,000.

Just before the 2010 Eurovision Song Contest in Oslo, Ms Borg applied for a second warrant of seizure, this time for €18,333.

These, the court said, were nothing more than manoeuvres aimed at demoralising the singer and cause her unnecessary anxiety.

But in her appeal, Ms Borg said these measures were only taken as legal avenues to safeguard her rights. She said that the first court had failed to evaluate properly the evidence presented and called on the Appeals Court to reverse the decision.
