Q: Three years ago, I bought a solar water heater, and ever since it was installed I have had a lot of problems. One year after it was installed, the water tank started to leak and had to be replaced. Now the replaced tank is leaking again.

The technician I called told me the tank has to be replaced once again. Can I ask the seller to replace the tank free of charge since it was replaced less than two years ago? When I spoke to the seller, he told me I am no longer covered. What are my rights in this situation?

A: Since the solar water heater was purchased three years ago, the two-year legal protection no longer applies.

When the water tank was replaced under guarantee, even though the replacement was carried out with a new part, the guarantee does not start from scratch. Since there isn’t a new purchase, the original guarantee continues.

Hence, unless you have a commercial guarantee covering the tank that is still valid, then you will have to pay for its replacement.
