Q: Three weeks ago, I bought a brand new sofa from a local trader. When it was delivered to my house, I noticed it had minor damages. I immediately informed the seller, who promised to come and check it personally, but to date he did not keep his promise.

What are my legal rights? I paid for a brand new sofa and the one I was delivered seems to be the same one displayed in the showroom.

A: Legally, you are entitled to what you agreed with the seller when you concluded the sale. Unless you specifically purchased the sofa displayed in the showroom, you are entitled to a new sofa. You can therefore ask the seller to replace the delivered sofa with a new one. If this is not possible, then you can ask for your money back.

If you do not manage to reach an amicable agreement with the seller, you may file a complaint with the Office for Consumer Affairs at the Malta Competition and Consumer Affairs Authority.
