Q: I purchased a table with chairs from a local seller. The delivery was supposed to take place about six weeks from date of order.

The chairs arrived on time but regarding the table we were told it would arrive soon afterwards.

Six months have now passed and we are still without the table.

After several complaints we were given a temporary replacement table which is different and of lower quality than the one we ordered.

Recently the seller informed us that the original table we had ordered will not be delivered.

Since we bought the chairs and table as a set, we do not want the chairs because they won’t match the new table we will have to buy from somewhere else.

We would like to know what our rights are in such a situation?

A: If you purchased the table and chairs as a set, and the table cannot be delivered to you as agreed in the contract of sale, then you may refuse the chairs and claim a refund of the money paid for the chairs.

If the seller refuses to take back the chairs and refund you the money, you may file a complaint with the Office for Consumer Affairs at the Malta Competition and Consumer Affairs Authority.
