A man who was run over on a pedestrian crossing in 2008 was yesterday awarded more than €38,000 damages after the driver’s plea that the sun had obscured traffic lights was thrown out of court.

Alex Azzopardi was crossing Valletta Road in Mosta when he was hit by a car driven by Anna Ellul, suffering face and knee injuries.

Ms Ellul told the court the traffic lights were obscured by trees and she could not see them because the sun had got in her eyes.

However, Mr Justice Lino Farrugia Sacco said it was the duty of every driver to maintain a proper look out.

He found Ms Ellul totally responsible for the accident and Mr Azzopardi’s injuries.

The court found that Mr Azzopardi had suffered a six per cent permanent disability and ordered Ms Ellul and Middle Sea Insurance to pay him €38,630.58 in damages.
