Driver wins compensation for damage caused by pothole

The Small Claims Tribunal has ordered Balzan local council to pay a woman €180 after one of her car's tyres was destroyed when she drove into a deep pothole.

The tribunal heard how the incident happened on January 16 last year at about 8 p.m. when Henrietta Bianchi was driving her Volvo from Iklin towards Balzan.

As she rounded a corner from Balzan Valley, on entering Balzan, she drove into a pothole which was full of rainwater. The tyre deflated and needed to be replaced.

Balzan Council pleaded that it would prove that it had done what it could to ensure that no vehicles were damaged. However during the proceedings no one from the council turned up to present any evidence.

The tribunal said it was one of the main roles of local councils to maintain the roads, something which Balzan council had clearly failed to do in this case. Furthermore no warning signs had been placed near the pothole.

The council therefore ordered the council to pay Mrs Bianchi €180, with interest.

I had a problem in St. Paul's Bay i had my Tyre damaged and the answer was that not all councils pay for the damage caused

The €180 bill maybe wasn't worth the hassle, but the sentence is definitely a huge milestone for Malta. It should now serve as an example for other cases that are sure to follow.

One would think that when you win a court case you will be entitled for legal expenses as well.

Sir if the pothole was the responsibility of the central government the case would have been thrown out of court as the wrong people were being charged.
But it did not happen that way, in fact the council were irresponsible enough not to show up in court.

my thoughts exactly, with the very small number of KMs of road networks in Malta, every road should be up to EU standard no time... but whatever

Maltese motorists are among the most heavily taxed in Europe. They deserve decent roads, something that no government has been able to provide to date. Not only that, but now we are expected to submit our vehicles for a VRT every 12 months. Sopra corna bastonate!

Mr. S Fenech - VRT's are held every 4 years and every year as you stated!

Having said that I agree with you that some of our roads needs urgent repair.

Regarding the above mentioned case against the Balzan Council, I can assure you this is not the first sentence against Councils by car oowners/drivers.

Going to San Gwann is a mess. If you choose to go from Birkirkara bypass you find the road from Mater Dei via San Gwann industrial Estate to San Gwann is a total car destroyer. If you choose to pass from Sliema road, as soon as you reach the top part up to the first turn into San Gwann center, is another car destroyer... VRT tests are going to get more severe BUT are the roads going to get better? I doubt it...
